Legal Question in Legal Malpractice in California

Have not found an attorney in 7-8 months searching!

After having carpal tunnel surgery via workers comp, the dr. severed my ulna nerve in the process. Nerve connductor tests later showed 90% damage and those dr's encouraged me to sue the dr. that did this. I was not made aware there would be a problem in advance. Because of statue of limitations, I have put off a 2nd surgery, to find an attorney to sue. This has proved to be a hugh task. I have all my records, mri's, xrays, etc. Made copies and overnighted them to many attys. All have rejected me. My hand is crippled and I have suffered pain, anxiety, depression, insomnia to name a few items. I cannot do many simple things to take care of myself. This man needs to pay for what he has done. Why isn't anyone taking my case? Where do I go? I have a workman's comp atty and he is no help at all either. Says its not his area. I cannot return to work, I cannot resolve the issues, and the ins. co. is a joke! They have played games all over the place, including denying med. treatment, causing appeals to be filed, stopped my disability illegally, which I got started again, and more! I am ready to take out a hugh ad in a very large newpaper to find someone, anyone to help me. I've sent intent to sue letter. Why is this so hard??

I could only guess why it's so hard, and that wouldn't be productive. A cautious attorney would have a medical expert first review all of your medical records to render an opinion whether the surgeon conducted himself below the standard of care in the community. Often, an attorney will require the client to pay up front for the pre-lawsuit medical review.

I salute your diligence. Please make sure to observe all statutory deadlines -- otherwise you will be permanently barred from filing suit.
