Legal Question in Legal Malpractice in California

Should I Sign The Settlement Papers?

I was in a car accident over a year ago. My lawyer had made the settlement without my knowledge and consent. I didn't know this until he sent me the settlement papers to sign. I don't want to sign to what I don't agree. What happens if I don't sign the papers?

Re: Should I Sign The Settlement Papers?

Your attorney can tentatively agree to settlement, but you can refuse. Before you do, make sure you are correct in doing that. Refusing to settle means the case would have to go to trial, and it may not be practical to do so. If you think the settlement should be higher, talk to your attorney about why he thinks the settlement is appropriate, then go pay for a second opinion from another attorney. Contact me if you want to do so, if the case is in SoCal.
