Legal Question in Legal Malpractice in California

Substitution of Attorney

If my attorney is requesting a ''Substitution of Attorney'' and make me ''Pro Per'' but I believe he has made an clerical error in my representation does my signing the Substition relieve him of responsiblity of his error? He has stated that if I do not sign he will make a motion to the courts to be relieved.

Re: Substitution of Attorney

Signing the Subsitution of attorney does not relieve the attorney of liability. However, the statute for bringing an action against him is 1 year once he is no longer your attorney. Please call me if you have any other questions. Can the clerical error be fixed?

Re: Substitution of Attorney

Signing a substitution of attorney form does not relieve an attorney of liability for any mistakes that may have been made during the coure of representation. If you have legitimate claim for malpractice, you need to consult a new attorney right away. You only have one year to file a claim for legal malpractice.
