Legal Question in Legal Malpractice in California

Can you sue a lawyer for malpractice? I hired a divorce attorney and he just sucks. His staff is rude, he doesn't return phone calls and worst of all he has made mistakes that have cost me time with my kids and thousands in child support.

Of course you can if you have actual proof of professional negligence, but not for having rude staff and not returning calls. Bad service is not malpractice (though refusing to keep the client informed about material developments in the case can be grounds for State Bar discipline).
