What is the time frame for filing a legal malpractice suit?

As usual when an attorney gives an answer . . . it depends. Generally, under CCP Section 340.6 one year after discovery or through reasonable diligence should have discovered the FACTS constituting the wrongful act or omission for negligent conduct. However, there is a tolling of the statute where there was no actual injury sustained, the attorney continues to represent regarding the specific subject matter of the alleged wrongful act or omission, the attorney willfully conceals the facts and the plaintiff is not under any legal or physical disability preventing the commencement of an action.
