Legal Question in Mediation in California

rescinding

after 9 hours of mediation we signed an agreement. We want to rescind this agreement because their lawyer added stipulations and also legalese that protects them fro us contacting others regarding settlement. We have already contacted IRS and many other whom this person owes money before this when this person tried to take our property. We do not want to sign final agreement for these reasons and want to know what the rescinding process is. Our lawyer says we will have to get another lawyer because he won't be involved.

Re: rescinding

When were the additional stipulations and legaleze added to the agreement - before or after you signed the agreement at the mediation? Were these additional stipulations and legaleze in the agreement signed at the mediation, or afterwards in the "final document"? Are you able to demonstrate any fraudulent statements or other actions that you believed coerced you or tricked you into signing the document? The answer to the above questions will help determine whether you can avoid the "added stipulations" and "legaleze" and whether you can rescind the underlying agreement reached at mediation.
