Legal Question in Medical Malpractice in California

Dental malpractice,

I started with some anoying symptoms from my first root canal made on July 15th, 2008. It was after a month or so that I came back to have it closed but it was cleaned only. After that was a problem after the other until in December when a tooth next to this got infected according to my dentist and he decided to have a root canal on this tooth too. Note that in one visit the Docs assistant made my tooth bleed when cleaning it (Indian assistant) By December 2008 I had two root canals and before Christmas I started having pain in both teeth. Temp. fillings kept braking so the Doc said it was OK and kept giving me pills. Note that tooth with root canal # 2 was hurt and bled also by Doc�s assistant ( Chubby girl) when pushed too hard when inserting the temp filling and gave me a lot of head acke and discomfort. Filling had to be replaced a couple of days later by Doc after explaining what happened he got angry. I had a second opinion made and was told I would need to see a specialist �cause tooth# had an extra root. I came back and told my Doc but said it as not possible, cleaned the teeth again and gave me more pills. Re: Dental malpractice,

If and when you are told by a dentist expert in that specialty that there was malpractice, and damage caused by it, and that he will testify to that, then you can file a malpractice action. You probably have only one year from discovery of the problem to file. Feel free to contact me if serious about pursuing this.
