Legal Question in Medical Malpractice in California

Gastric Byass gone very wrong

I had gastric bypass surgery and during the surgery the doctor nicked my bowle and did not repair it. I became seriously ill after the surgery and ended up having emergency surgery to fix the leakage from the bowle. I have been to lawyers and they say that I have a claim but that after the settlement there would be no compensation for me. After all of the lawyer fees. Does this sound normal?

Yes.

You will need expert testimony, frequently from doctors who charge as much as $10,000 or more to testify. Also, you need testimony that the surgery went bad because of poor judgment or error by the doctor. Gastric bypasses have a very high rate of complications, and you may have signed a release excusing the physician in advance.

I agree with the lawyers you have already seen, since after all expenses and legal fees, there would probably be little left over for you.
