Legal Question in Medical Malpractice in California
Went to a medspa for a chemical peel. Nurse put the chemical on my face then proceeded to leave the room and never return. My face was on fire and I had to track down another nurse to remove the chemical. After removal it was still burning so nurse put a sulfa based cream on my skin even though I am allergic to sulfa and noted it on all paperwork. So now my face has permanent scars from the burns. What options do I have?

Your options are to do nothing, or sue. Most medical malpractice claims are initially denied, and require a lawsuit. When claiming medical malpractice, your claim must be supported by the opinion of a 'qualified expert' in that field of medicine, who is prepared to testify in court that there was malpractice, meaning the treatment fell below the acceptable standard of care, and that such negligence caused legally recognized damage. However, it is pretty clear what happened, you should have no trouble obtaining an expert. Keep in mind that you have only one year maximum from 'notice' or learning of the suspected malpractice to bring suit.
