Legal Question in Medical Malpractice in California

Plastic surgery disaster

My plastic surgeon ruined my left eye 2 years ago. I couldn't sue him within 1 year, since I couldn't find an attorney to represent me. My left eye doesn't close and swallen in the morning. Can I at least file a small claim against him or it's too late?

The Statute of Limitations is straight forward. You can not sue. BUT, you might be able to sue for breach of contract.

The statute of limitations is tricky for medical malpractice. It sounds as if, from the little info you have provided, that the 1 year statute would be applicable. If so, you would probably lose the case on a statute of limitations defense. However, please feel free to contact me
