Legal Question in Medical Malpractice in California

i recieved a letter stating that i needed to call the hospital at the number provided, the nurse told me that during the time i had a procedure in October with a camera scope that had been up my nose and down my throat, I had been exposed to blood borne diseases as the scope hadnt been cleaned properly. They want me to go for labwork at their expense of course but I am furious, do I have a case?

Yes. You should retain an attorney, keep documentation, and get tested. Hopefully you are ok, but if you test positive, you have a case.

IF and when you have any medical problems caused by it, then you'll have a valuable case. They have already admitted causation. You need to be examined and tested to determine if you have problems; you can let them do so, but should do it independently as well to be sure you get an accurate answer. They should pay for that testing. For the moment, your claim would be limited to 'emotional distress', which may have some value, even if nothing else occurs. Please feel free to contact me to discuss your rights and remedies if you are serious about pursuing this.
