Legal Question in Medical Malpractice in California

My wife is taking tablets for PCOS and doctor prescribed Metaformin HCL. I picked up the medicines from CVS and about 27th day my wife noticed 3 pills of different size within the bottle. When we asked the CVS shop, they said it was the mistake of the machine.. The tables would had got stuck or something. Those were escitalopram tablets. My wife is not very sure of consuming the other tablet. It is a anti depressant. What options do I have? I got the medicines back with me.

This isn't medical malpractice unless your wife 1) took the other medicine; and 2) suffered an adverse reaction; and 3) that adverse reaction was sufficiently bad enough to justify the costs of litigation, which isn't very likely at all unless your wife wound up in the hospital, which didn't happen.

So, this is a really a consumer issue - they gave her a couple of the wrong pills. They may not have even shorted her on the Metformin. If they did, you may be able to get a couple of pills out of the pharmacy.
