Legal Question in Medical Malpractice in California

What Went Wrong!!!

I recently had a abortion at a clinic and had complications, I was told by the Dr. at the clinic that my uterus was twisted and this would make the procedure difficult. They attempted to perform the abortion to my knowledge, I then came home and days later I started to bleed and pass alot of blood clots. I called the clinic back to inform them of these developments and they said this was normal, I was still bleeding really bad and went to the local emergency room and was told by the Dr. there that the abortion was not completed and I needed to be hospitalized to have a D&C, I have now developed a blood clot in my leg and have been going back and forth to the doctor and have lost time from work. I would like to know can I be compensated in any kind of way and is this clinic liable for any type of malpractice for there work.

Re: What Went Wrong!!!

IN RESPONSE TO YOUR QUESTION, THERE ARE SEVERAL ISSUES THAT MUST BE DECIDED IN YOUR FAVOR TO HAVE A VALID CLAIM FOR MEDICAL MALPRACTICE. FIRST, YOUR TREATING DOCTOR MUST HAVE BEEN NEGLIGENT WHEN HE OR SHE PERFORMED YOUR ABORTION. SECOND, THE DOCTOR'S NEGLIGENCE MUST HAVE CAUSED YOU DAMAGE. FOR EXAMPLE, THAT YOUR SUBSEQUENT MEDICAL PROBLEMS WERE CAUSED BY THE DOCTOR'S NEGLIGENCE (AND WHAT THE DOCTOR DID WAS BELOW THE STANDARD OF CARE IN YOUR COMMUNITY). IF YOU WOULD LIKE TO DISCUSS THIS MATTER YOU MAY CONTACT ME DIRECTLY AT MY OFFICE (818 597-2610). THANK YOU, HOWARD SILVER.
