Legal Question in Medical Malpractice in California

A few years back I had a surgery where the surgeon accidentally cut my femoral nerve in my leg which left me not able to walk without a brace. I tried to sue him for medical malpractice but unfortunately the attorney said the expert witness didn't think we would have a case. So my question is can I sue him in small claims court for the medical bills which is all the co-pays etc that I have come from my rehab due to the surgery went wrong?
