Legal Question in Personal Injury in California

When I was in 7th grade I was playing basketball at a park that had their rims lowered (so we can dunk) The net was a chain net. One day I got my nose caught in the net and ripped my nose wide open. I had 7 stitches in my nose. I am now 32 but it still is an insecurity for me as it made my nose alittle deformed. You can still visibly see the scar. I remember meeting with a lawyer as my father wanted to sue. My mother felt it was not a good thing to do, so we did not go through with it. It was a city park. My question is can I still sue the city for emotional and possibly plastic surgery damages 16 years later?

No, I'm sorry, but the statute of limitations expired on your case long ago.

Mr. Molloy is correct.

20 years ago the statute was one year which started to run the day you turned 18.

I do not see any vehicle for you to sue. The problem with being a child is that we always get injured, one way or another. Even if there was a way to sue, I would be reluctant to sue a park for such injuries, unless there was some sort of dangerous defect with the equipment. Personally, I think your mother probably had the right call.

Good luck.
