Legal Question in Personal Injury in California

I was in a accident with someone with no drivers licence, no insurance, no phone that I know of. I have a feeling there illegal with no money. I have a police report that shows clearly they are at fault. What can I do? Also, I don't understand why they let the lady go on her merry way.

First of all, they let her go because having no driver's license and no insurance is not an arrestable offense. I'm sure they gave her a citation and order to appear in court though, if that's any consolation. As for your options, it entirely depends on whether or not you were wise enough to buy "Uninsured Motorist" coverage. If not, then you have no case. As was stated by the other attorney, uninsured motorist insurance coverage will help you. Your auto policy should have this coverage which steps into the shoes of the negligent driver who is also not insured. That coverage will pay your medical / hospital expenses, loss of earnings plus your pain and suffering (up to the limits of your policy) depending on your damages. Your collision coverage (if you have that coverage) will pay for your car repairs. You should seek the advice of an attorney. I hope this helps. Bob
