Legal Question in Personal Injury in California

attorneys fees and workers comp

we have a personal injury case that will settle this year.our attorney is working on a contingency. since the accident happened at work, we recieved workers comp payments for three months and theypaid the medical bills,but now workers comp says we must pay them back since we are going to recieve a large settlement.is there a way to make them pay some of the legal fees?or a way to include those fees in our suit so the defendant will pay them?
