Legal Question in Personal Injury in California

Auto Accident - Seeking Lawyer

Hello to all,

I'm writing on behalf of my mother who was rearended at a traffic light on 4/17/04. A claim was filed with the other party's insurance on 4/22/04 and haven't heard from them yet. My mom currently has severe back pains and has visited a doctor. She has to take 2 weeks off from work to recover which I doubt the other party's insurance would cover. I would like to seek a lawyer for advice and prosecution. Thank you very much in advance.

I'm sorry your Mom was hurt and I hope she recovers soon.

There are lots of good lawyers on LawGuru and I'm sure you'll hear from many of us. Yes, the other party is responsible for your Mom's lost wages, as well as any loss of future earnings (in addition to medical bills and sums to compensate her for her pain and suffering).

Tell Mom not to give statements or sign anything for the other party's insurance company until she has retained an attorney. Congratulations on acting quickly to seek legal advice. And yes, I would be pleased to hear from her.

The most important thing is getting your mom the appropriate immediate medical treatment, which she appears to be getting. We'd be willing to work with you and your mom, as well. We're in the Beverly Hills area, should you be on the West Side. (310) 858-9771.

Re: Auto Accident - Seeking Lawyer

If you think you need a lawyer you probably do. Insurance companies have become increasingly stingy with fair settlement offers particularly in rear end collision cases. The insurance companies have advertized in fighting propositions on the California ballot to convince the jury that attorneys that represent injured people are bad and that law suits by these bad people are responsible for many bad things happening in the California economy.

People believe that jury verdicts are responsible for loss of jobs, a poor economy and other problems faced by other Californians. This is a belief while the number of injury cases going before juries has steadily declined over the past ten years. This is the belief even though most of the jury verdicts are conservative.

Thus jury verdicts in those types of cases have been low and it has been difficult to get fair value for the injured parties.

In any injury case it is important to preserve evidence at an early stage and seeing a competent attorney early can be of substantial help in getting a fair result, whether by settlement or trial. People need to know that it is very important for injured people to tell the truth, get needed medical care, follow their doctor's advice and when necessary get representation with a reputable lawyer. Good Luck.

First, it can take awhile for an ins. co. to process a claim and get in touch with everyone. The medical bills and the wage loss for your mom would be compensated along with pain and suffering. We'd need to have good photos of the damage to her car as well. If you are in the Orange County area, please look at my web site and give me a call. I'll be glad to help.
