Legal Question in Personal Injury in California

automobile accident uninsured

I was involved in accident and was not insured, my license may be under suspension. I offered to pay expenses for accident (i rear ended her) or she could file through her insurance as she felt comfortable with. Under California vehicle codes and laws, where do I go from here? Is there anything ''pro-active'' at this late date I can do? Essentially, I have no money.

When you get some money, you can hire an attorney to do a bankruptcy. That will get your license back.

First, there is a possiblility the DMV could suspend your license for a year. Then you'd have to pay a fine and get insurance to get the license back.

Then, if the other driver takes money from you, have her sign a release of all claims for injury or property damage. If she goes thru her own ins. co., that company may come after you for re-payment. But for you, if you have no money, assets or property, they can't get anything and you don't have to worry. There's not much to do right now but wait to see who contacts you.
