Legal Question in Personal Injury in California

We had a three car accident in November 2007, the insurance company has been trying to get money because we had the minimum coverage. What are the statues for them to come after us directly. We don't own anything so they have nothing for us to come after, will this end or can it continue till something is done. Do the statues apply here since they have already filed? What can they come after? Thank you so very much.

The statute of limitation applies to the time by which a lawsuit must be filed.

The opposing driver has filed suit against you. Neither the driver nor the insurance carrier can go after your assets -- including bank accounts, wages, and real property -- until after a judgment is entered in the driver's favor.

Your insurance carrier should negotiate to protect you from any judgment in excess of your policy limits and should enter a defense on your behalf.
