Legal Question in Personal Injury in California

Do i have a claim as father in my sons near drowning suit? He lives with his mom now. My children were taken from the mom and while in foster care my son drowned n the foster parents pool after working on him for 30 min. the paramedics brought him back this happen in April 2010. I cant sleep. I got the call at 9p. every time the phone rings at that time think its something horrible . I have nightmares and cant afford mental health care so the past two years I been going thru his. Mom is currently suing the county and foster care agency.

No, bystander emotional distress claims require you to have been physically present when the injury to your child occurred AND to have been in danger yourself.
