Legal Question in Personal Injury in California

Clerk Default in Muni Court w/o SOD Good In Superior Court?

Hi. Please let me know if you think the default entered by the municipal court clerk without a statement of damages will hold up now that the case is in superior court? The defendant was served with a summons and complaint and not a statement of damages. What can I do to increase my chances of collecting? The default was entered against the permissive driver of an insured owner who, I'm told(?), is limited in his liability to $15,000. I also understand the driver's liability is unlimited(?). The owner's policy is for $1,000,000. I'm not sure if his policy will cover her. What can I do to increase the chances of his policy paying for her? Time is of the essence on this... Many thanks in advance!

there is nothing you can do to increase chances of coverage. that is based on the policy language and the law.
