Legal Question in Personal Injury in California

My dad was in a terrible accident where the police report declared the other driver at complete fault. My dads vehicle rolled several times and was totaled. He went through months of physical therapy and limited duty at work. He is 61 still has neck and shoulder pain. Triple A wants to settle and they are only offering him $5,000.00 is that fair?

Sorry about all of the pain and suffering that your father is going through.

Liability insurance policies in California typically have a $15,000 minimum limit. It sounds like this "offer" of $5,000 may just be part of a medical reimbursement portion of the other driver's policy. Or, it's possible that your father has "Med-Pay" under his OWN insurance policy and they are simply offering this as payment under his policy.

He needs to find out for certain BEFORE signing ANYTHING.

I think he should consult with an attorney to discuss his options.

I used to work in claims before becomming an attorney and I understand how they think. Many insurance companies including but not limited to Mercury would make a rediculous offer regardless of the injuries or damages, not caring what you think or do. I think at this point you know the offer AAA made to your dad is pure crap and he needs a lawyer. My advice is find a good trial lawyer who is not afraid of taking cases to trial and advancing costs to hire experts. The best source is people you trust who might have had similar situations.
