Legal Question in Personal Injury in California

Defendant reuquest social security number.

After biting into a mutated (rock hard) form of food which cracked my permanant bridge in half and contacting company who makes and apckages this product, they replied by sending me 3 small coupons and a form they demand I fill out so they can ''further assist me'' with my claim for a broken bridge. I have no problem in sending them med records or a doctors release form. However, I do take extreme exception to the fact that they demand I include my social securiy number. I have had my identity stolen once already and though I have no doubt this large corporation would have no interest in this sort of activity - I still belive this request goes beyond what is necesary to resolve this issues. Why would they want that information in any case other than for employment?

Before doing anything, I would have an attorney look over the forms to make sure that you are not waiving your rights to sue the manufacturer.

You do not have to give your social security number. also, have an attorney look over the forms to make sure that you are not waiving your rights to sue.

Re: Defendant reuquest social security number.

Do NOT sign anything or give them any information (including your SSN) without an attorney reviewing the documents beforehand. I just settled a case against a restaurant for serving a defective item which caused my client's teeth to break. If you need further help, feel free to call me or email me. Thanks for your question and good luck.

Re: Defendant reuquest social security number.

Firstly to answer your question. The reason why you are asked to provide a SSN# for purposes of settling a personal injury claim is that the insurance companies use what is called "The Index." All claims against insurance companies are put into this index. Basically they want to check you out against the index to see if you have had any other claims for the same injury or other information about you that may help them to accept or deny liablity for the injury.

That being said, I agree with the previous responses by the other attorneys on the system here. I will go one step further and suggest to you that you should not go about settling this case alone. You will almost always get screwed without an attorney because you do not know what compensation you are entitled to for a personal injury claim. Give me a call, I can deal with this case for you. 818-427-6246
