Legal Question in Personal Injury in California
Disclosure of insurance amount
My car hit in a car accident. I demanded the insurance company of the insured to disclose the policy amount but the insurance company does not disclose the amount stating the insured does not consent to it. Please tell me whether the insurance company has the obligation to disclose the policy.
Secondly, the medical expense amounted to about $5000 soft tissue. My doctor keep on saying this is the best he can do due to maximum medical improvement has been acheived. I still sufferf from chronic back and neck pains which makes if very difficult for me to carryout my active lifestyle of roller blading and bycycling. How much can I recover for pains and sufferings and future compromise of my lifestyle.

Generally, the insurance company for the other party does not have to disclose the policy amount. It is considered confidential information and unless the other driver consents to the release of this information, the insurance company will not divulge the policy limits. The other way to obtain that information is to file a lawsuit and then it can be obtained through the litigation process.

The only thing you can do now is sue. I worked as an attorney for most of major insurance companies, State Farm etc..., and that's how they play the game. As long as the money you should have is their account they earn the interest.

Yes, they have the obligation to disclose once the case has been filed and discovery has commenced. Form Interrogatories request policy information. However, I would recommend that you obtain representation immediatlely. Lost wages, lost earning capacity, medical bills, future medical costs, and, pain and suffering are awardable. Your damages may be beyond the policy limits. You need to obtain representation immediately so as to attempt to have the insurance company cover in excess of the policy limits.
