Legal Question in Personal Injury in California

Am i entitled to claim against my own insurance for bodily injury coverage eventhough< based on the police report that im at fault.Since im severely injured> My own health insurance paid for most of it except for deductibles and co payments? please help. thank you

Police reports can often be wrong, either in whole or in part. When the injury is severe, I can often get a recovery for my client even against an adverse police report. As the other attorney stated, police reports can be incorrect and may make bad assumptions and conclusions. They are not evidence legally unless you or the other driver provided statements to the investigating officer and then llater changed your statements which proved to be inconsistent, Then the report could be used to impeach. If the true facts suggest that the other driver was partly or fully at fault for the accident it does not matter that you were determined to be the cause of the accident by that police officer; you could still make a claim, but you do have the burden of proving the actual cause of the accident was the other party and not you.
