Fell at a Grocery store, what are my rights?

My mother fell in the parking lot of a grocery store at 9:30 pm. As a result of this fall, she bruised her knees and hands. The next day, we notified the Store Manager of my mother fall. He passed the claim onto a Construction Company that was doing work for the grocery store, saying that it was the Construction Company's fault that my mother fell. The Construction Company contacted my mother stating that ''a normal person would have been more careful of where he/she was walking and that the fall was her fault.'' Also, the Construction Company said their not liable for my mother's fall because they were working on the inside of the Grocery store not the parking lot. The Construction Company said that it would get back with my mother. To date, no response yet. What are my mother's rights?

Both the store and the construction company would be liable. Your mom's conduct is held to what reasaonable person would. Don't to settle. She can have serious damage in her knees. I practice in California and Indiana.

Your question reminds me of the one hour final exams we used to take in law school. What your mother's rights are may depend upon a number of variables and individual factors.
