Depending on the value of the damages and injuries, it could be small claims, limited jurisdiction, or unlimited jurisdiction case. Small claims would be for damages and injuries under $7,500. Under $25,000 would go to superior court limited jurisdiction, and over $25,000 would be in superior court unlimited jurisdiction. You'd never file an accident case in U.S. district court, unless the defendant is a citizen of another state, and the value of the case is over $75,000.
