insurance company wants figure to settle bed bug injury

Husband and child were subjected to bed bugs at CA hotel suffer ongoing allergy. Hotel had documented infestation prior to our stay. The city codes eventually confimed scope of infestation and hotel finally cleaned up act and took major steps to treat infestation. Prior to our stay documented prior 2 year infestation. The city has provided letters to us confirming the infestation and the hotel is required to provide monthly reports and a plan for educating staff. 20 rooms involved rooms some closed for 6 months.

The previously uncooperative insurance carrier (Zurich) now is asking for a figure to settle this claim.

Have no idea what to say.

Child is seven. It is not life threatening and allergist says not much to treat it other than meds and time will diminish frequency of ongoing allergy. It has been a really miserable experience having to treat our home, clothing etc. Family is afraid of staying places and getting bitten.

What should we do. Is it wise to give thr insurance company a monetary figure.

You need to think of this case like an auto accident case. There are many more damages that you are entitled to than the insurance company will inform you about. It may be wise to make an offer to the insurance company. However, no one can tell you what number is fair until we have a lot more information. You might want to read my blog, www.calpiblog.com, or if you prefer, listen to my podcast, www.personalinjurypodcast.com, for information on how to calculate damages. This is one of the situations when talking to an experienced attorney can help you figure out the fair value of your case. Especially dealing with children, it is sometimes hard to put a value on it until they have stabilized medically and we know if they will need future treatment.

You should consult a personal injury lawyer promptly. A good consultation will suggest a fair amount to demand as compensation, and a good lawyer will be better suited to obtain it for you, or at least have better judgment to determine what a fair compensation is for your suffering. Good luck.
