Legal Question in Personal Injury in California

I was involved in an accident in the beginning of November 2005. A lady with a new Lexus SUV backed into me and then took off. People chased her and because it was a bran new car we couldn't get her license plate and she got away from the bystanders who were chasing her. I somehow found who it was got a police report and in the police report the detective had said that I had identified the correct person because when she was trying to get away from the bystanders she had ran a red light so they had gotten her picture. Can I still sue for my damages and my insurance deductible and all the expenses I incurred or is it too late?

The three-year statute of limitation for property damage has run. However, if your carrier paid to fix your car, it has an extended time to sue in subrogation and perhaps recover your deductible.

.Unfortunately its too late. You have 2 years to file a lawsuit for personal injury and 3 years for property damage in California.
