Legal Question in Personal Injury in California

I was involved in a auto accident on Jan. 10, 2017, that resulted in my neck being injured, and $1600 damage to my vehicle. The party that hit me was driving a commercial work van, the accident was 100% his fault, the company was insured. I have never been in a auto accident that resulted in any injuries, therefore I met with a lawyer I found from a tv commercial in the area where I live, and ended up agreeing to have him represent me in my personal injury claim. Initially I was seeing a chiropractor a few times a week for approx. 3 months, with minimal relief for the pain in my neck. I then had a MRI done that showed I have 3 bulging disks, one that is dangerously close to my thecal sac. Next I had a epidural done, which relieved some of my pain for several days only. I’m not going to have another epidural, and surgery is out of the question, I’m only 40 years old. I’m a full time student, and Veteran that receives all my healthcare for free. I retained this attorney eleven months ago, and received one phone call from him during this time. When I call to follow up on my claim, I’m always sent to voicemail and it takes 2-3 days to get a returned call. When I do finally get a returned call it I’m told the same thing over and over, were gathering documents. Honestly, I feel like my claim hasn’t even been looked at, I’ve told them three times it was a commercial van that hit me, during our last conversation they acted surprised when I mentioned this again to them like it was the first time they were ever told that. I know nothing more about my claim than I did eleven months ago, and they are telling me it will be another six months at least to settle my claim, and the claim settlement will probably be a minimal amount. I feel like they are overloaded with claims and mine is just floating around at the bottom of a pile somewhere that they will get to someday. They want to collect 30% of my settlement, and I’ve received one phone call from them in eleven months, and know nothing more than I did when we started this process, this doesn’t seem right to me at all. Is it just me, or is this the way claims are handled professionally?? Can I find another attorney to handle my claim and terminate this one???

Sadly this is a very common story, but the good news is that you can substitute attorneys at any time, at no additional cost to you. Give me a call and you will see what it’s like to really talk to a lawyer. Anyone who consults with their attorney should come away feeling informed and educated. That’s why they call us “counsel.” Some of us try to live up to that title. Here is my info:

While it is impossible to know without seeing your file if your lawyer is doing a good job or not, one thing is clear their communication with you has been lacking.

You can change lawyers easily as many times as you wish without incurring additional fees.

I do this type of work and I try cases regularly. Feel free to give me call if you wish.
