Legal Question in Personal Injury in California

Jurisdiction and Forum for Lawsuit

I was involved in a motor vehicle accident in Southern California while on my honeymoon. The driver of the vehcle that struck my vehicle is from Virginia. I know I can file suit in the Sate and county where the accident occured but can I also file suit in the county where I reside?

You received three good answers. One more choice, however: if your case is worth more than $75,000, you can file suit in Federal Court in the district that covers the location of the accident.

With the facts you have provided, it would seem you have two choices for filling your law suit. You can either file in the county where the accident took place or you can file in the county where the defendant lives. Good luck
