Legal Question in Personal Injury in California

Can law enforcement impound an inoperable vehicle less than one hour after the accident? The driver received a ride home to call tow upon returning an hour later, vehicle had been impounded. It was not obstructing the road, it laid on the shoulder.

Did the police know for sure that the owner/driver was going to pick up the vehicle? Even if it is on the soft shoulder it can be a danger as drunk drivers often smash into stopped vehicles. if you file a claim [must do so within 180 days], they will just reject it and you probably will not win in Small Claims Court [if you do, they can appeal it and then you will face one of their attorneys in Superior Court].
