Legal Question in Personal Injury in California

liability release?

I am pending a lawsuit for a freeway head on accident that totalled my car. This accident was in no way my fault as stated on the police report. Why is my attorney demanding I fill out a liability release form which states I have no claims to any property damage? I have asked why I need this filled out when my case isn't closed and have not been given an answer that I feel good about.

I don't know why your attorney is asking you for the waiver of liability. You might sit down with your attorney and have the attorney explain it to you before you sign so that you understand what the attorney is attempting to do.

You don't say what answer you've been given. I can only presume that the carrier or the other side thinks they are paying in settlement of any and all claims you have for property damage, as opposed to personal injuries, medical bills, lost earnings, etc. If that is the case it is appropriate as long as you are satisfied with the amount of recovery for property damage.
