Liabillity for damages during towing

My car was towed after breaking down on the side of the freeway and being left in an excess of four hours. The tow company damaged my car while lifting it up on the flatbed tow truck. I have paid for the towing and am now seeking money from the tow company for the damages that I noted and listed on the towing reciept. The company thinks the charges are to much and now refuses to pay after stating that they would take care of them. Is the tow company liable? What laws or documents suport the tow company's liabillity?

Sue them in small claims court.
