Legal Question in Personal Injury in California

Libel

If someone says something to a group of people that is incorrect but is meant to lead people to believe something about me, does that constitute libel. What if this person lives in another state from me?

Re: Libel

First you should forget the whole matter. If you just can't get over it then here are some of your legal hurdles. Spoken defamation is slander. Written defamation is libel. Slander requires that you prove your damages unless the matter is one of the two or possibly three matters that require no proof of damages. such as are you a leper? It's highly unlikely that something said about you in another state has damaged you. Damages would be a provable loss of income. Libel doesn't require that you prove damages. Unless it is libel per quo (or something like that). In which case all you have to prove is that it isn't true. So now all you've got to do is get together 20 to 30 thousand dollars and start a law suit. Oh yes, if the people that lied about you don't have any money your out all your money suing them. Even if you get a judgment, there's nothing to recover damages against. Lots of luck. I personally never sue anyone that doesn't have millions of dollars to recover the damage award against.
