Legal Question in Personal Injury in California

oc auto accident

Hi there. was involved in an auto

accident dec of 2006. there were

total of 4 people in my car, the other

car was at fault. The driver was

drinking. I recieved money for car

repairs and car rental during the time

i was out of a vehicle. now the other

insurance company is offering a 10k

settlement for all 4 of us. That

doesnt even cover 1 persons medical

bills. our lawyer is wanting for us to

go small claims court where each

party can only recieve a max of

7500K. I need a 2nd opinion....please

Sounds like the lawyer isn't going to make money and wants to get rid of you.

Quick answer. Fire your lawyer, and get a new one. It may be that your passengers and you belong in small claims, but you do not have adequate input here.

Also, it is very likely the other insurance company will offer much more.

The insurance company has at least $15,000 to pony up. There may be uninusred/underinsured coverage to access or some fault by another vehicle. Also, the driver is liable beyond the coverage.

Sorry to hear about this. It could be an issue of collecting a judgment - if the other parties don't have assets and insurance. There may be options but it would take more information than you provided to evaluate. Good luck.
