Legal Question in Personal Injury in California

had oil change done at jiffy lube, same day got on the freeway low oil pressure light came on...engine ceased. Looked under hood and there is no oil filter. Called Jiffy lube and they said that they have had some problems with that filter model number and that i can rent a car and they will repair the engine. My problem is I put every mile on this car and took very good care of it. They want to put a used engine in this car and to me that is unacceptable, this would have only a 90 day warranty. I want options on getting something newer even if i have to pay even though i don't feel like i should. Do I have to accept a used engine being placed in my car? My car has 108K miles and they are putting a used with 104K. I spent $1400 for new heads like 9 months ago and i just don't want someone else's junk that I don't know whether or not they took care of it or not.

They are liable to make you whole with the equivalent of what you lost, no more. They could pay you the money value of your used 108k engine, or they could buy you another used engine with similar mileage. There is no way they can get you the very same engine you had, and the law does not require them to do something impossible like that. If you feel like you need to know more about where the engine comes from, then have them give you the money, and you go do the shopping.
