Legal Question in Personal Injury in California

Pain and Suffering

I suffered neck and back injuries in an auto accident.

My husband is severely disabled (brain tumors). I have been unable to take care of him and have had to rely on friends and family to come over and help. I cannot drive, cook, do the laundry, or anything. My life has come to a screeching halt. Will the impact on my family be considered when it comes time for compensation?

Re: Pain and Suffering

I note that your question to LawGuru.com has been directed to me as I specialize in Personal Injury.

Given your situation, the impact to you and your family can be divided separately concerning your own claim and that of your husband.

Concerning your own claim, your inability to help your family would be considered part of your mental, emotional and psychological pain and suffering which is a component of your overall bodilyi njury case.

Your husband may have a separate loss of consortium claim for his los of your various services in attending to him.

Obviously, your situatiaon should be discussed in detail with a personal injury attorney. If you are in the Southern California area, please contact me at (714) 963-5123 and I will be glad to provide a free consultation. I wish you the best of luck.

Sincerely,

SAM M. EAGLE

Re: Pain and Suffering

Yes, it is called loss of quality of life. You are the primary care taker of your family and this accident has severely impaired that. It sounds like you have a lot of things that need to be taken care of without the additional hassle of dealing with insurance companies. The main reason you hire an attorney is to deal with every aspect of your case and get things back to normal so you can get back to your life. I work on what is called a contingency basis. This means that I get paid when the case is settled. I can help you arrange for a rental car while your car is either fixed, or you are given money to buy a new one. I can arrange for you to see a doctor and/or a chiropractor without having to pay them money up front if you don't have insurance, or it isn't covered by your insurance. When you have finished treating with a doctor and/or chiropractor for your injuries, I can help you figure out what a fair settlement is and fight to get it for you. My office is centrally located in San Luis Obispo, which is half way between LA and San Francisco. I also have satellite offices in the Bay Area, and Fresno. This enables me to handle cases throughout the State of California. I have specialized in auto accidents for over a decade, and I have never lost a case in Court. If you are interested in a free, no obligation consultation to discuss your case with me, please feel free to contact my office toll free at 877-546-9918. You can also contact me by email with your name, phone number, and a good time to call. I can then call you at your convenience to discuss the case. If I don't hear from you, I wish you the best of luck, and I strongly urge you to consult with an attorney before settling your case.

Best Wishes,

John Hayes, Esq.

Re: Pain and Suffering

Absolutely!!!!! This is what the key determination is. The impact on your life, activities, etc. is critical to an evaluation. In addition, your husband may have a claim for loss of consortium, comfort and society, due to the fact that you are not there to care for him as you were in the normal course. If you would like to discuss this, give me a call.

Re: Pain and Suffering

The impact on your family will be taken into account if you have a knowledgeable, dedicated law firm on your side. The insurance company for the party who casued your accident is not likely to provide you the full compensation you are due without expert legal representation. You have rights that you haven't even asked about. My strong suggestion is to consult with an experienced, reputable law firm that is committed to superior representation of their clients. You have many rights. Turn over the legal issues and matters to a professional personal injury law firm and you go on about getting better and taking care of your family. All good to great personal injury firms will advance costs and take no fee until they have collected what you have comming for you. They will all give you a free consultation. Please, for you and your family, consult with at least one of the many really good personal injury firms in this State. Of course, we would love to be the firm you choose. But do get someone sooner rather than later. And please, do not communicate with any of the insurance companies any further until you have consulted with an experienced personal injury attorney (not someone who is in general practice but a law firm that specializes in personal injury work).
