Legal Question in Personal Injury in California

parking lot accident

i was hit by a car in parking lot driver side.i was on main parking road and this lady hit me from the sub road from the side(like a intersection, no stop signs though).police was called, they said its private parking and cannot register a case.insurance is not cooperating, the other party is not co operating atleast to pay the damages.i have a auto body cost of 5000$. can i sue?

Not only can you sue, you will have to sue the other party to recover damages. If the insurance carrier and other party will not cooperate, your only recourse is to file a lawsuit. In addition to the property damage, did you sustain any personal injury? The answer to this question will determine whether you choose to sue the other party in small claims court (which has a $5,000 limit of recovery) or in Superior Court with the assistance of an attorney. Obviously, you can sue. Do a diagram, take photos and have your evidence in order. If your car is your only claim, you can go into small claims court.
