Legal Question in Personal Injury in California

Ped Vs. Auto

A person not long ago ran into the side of our car with her body and everything including the witness, police report and our insurance says that we were not at fault because she was not in a cross walk and she ran through moving traffic. However, my insurance has made it my desision if we should go after them for the damage that was done to our car. My insurance makes it seem as though they are scared of her even though the accident was not our fault. We are out some money and have become under economic destress because of this person hitting our car. I would like to know if i should bother with a law siut or not. She does have a lawyer but has not filed suit against just our insurance and they denied her. HELP!
