Legal Question in Personal Injury in California

Personal Injury

In February 2001, I got second degree burns in a hotel room in Los Angeles. I ordered tea from room service and when I went to poor it, the lid fell off the french press and the water landed on my lap. The room service man and my father were both present. I had to take time off from my private university and I have yet to receive any reimbursement. Is it too late to take legal action against the hotel?

The statute of limitations is one year from the date of the accident to file a lawsuit or settle a claim in the state of California for personal injuries. So if the one year has not passed, you still have time. However, I would act immediately since an attorney needs time to prepare and file a lawsuit.

NO, IT IS NOT TOO LATE.

The statute runs this month. Find an attorney quickly and file the claim immediately, like today. Further, if you can't find one go to the court house yourself and file it. They have lawsuit forms that are check the box that you can fill out and file yourself. If you do not file it on time you will lose the ability to sue forever.

Assuming it didn't happen the first week of Feb. last year you have 12 months to the day to file the complaint.
