personal injury & lost wages

Can I still file a claim with my own insurance after I file suit on 05/25/2001 against other party? MY statute of limitatation expired 06/09/2001.

I need more information to give you a good answer. In general your insurance company has no obligation to pay you anything unless your damages are more than the policy limits of the person who hit you and you have received those policy limits, or the other person has no insurance.

However there are certain provisions of your policy that may apply regardless of the other persons insurance. For example, you may have medical payments coverage. This would obligate your insurer to pay your medical bills (usually incurred with the first one to three years after the crash, depending upon your policy) regardless of what type of insurance the other driver has (or doesn't have)
