I purchased a burger from a fast food restaurant and the meat patty had already been bitten into and served to me, is there lawsuit that can be filed? If so, what category?

Unless you were injured and received proper medical treatment there would be no case. Being grossed out won't get you a dime, but maybe a gift certificate if you brought it to attention of the manager in a timely manner.
