Legal Question in Personal Injury in California

I was rear ended Dec. 2009. Damage of the car was minimum. I called other party's carrier and told them the situation. they send adjuster to estimate the damage of my car. It came up less than 400.00. I have never received any money from them yet. However i have a pain my neck. So, I went my doctor and said i have a strain neck. have treated by PT for a few times. Those are the under my health insurance. so each time I pay the co-payment $20.00. total 80.00 came out my pocket so far. I tried to contact the carrier several times left messages, to let them know that I was injured from the accident. They won't return my call, the Last time I received letter from them was the end of the January and stated that it under the investigation. I have not hear from them since. It's looks like a they are avoiding me. Do I have right to correct what I lost? Please advice me

You used poor judgment in contacting the insurance company directly and in not immediately retaining a personal injury lawyer. Now you have probably given them a statement and signed a bunch of things for them that will hurt your case. They will stall you forever until the legal time limit for suing the other driver runs out, and then you will get nothing.

It is not to late to try to retain an attorney but many attorneys will not take these low impact cases.However the carrier should pay for the damage to the vehicle and for the pt but they wont pay much more than that if anything depending on the identity of the carrier.Some are not as bad as others.

Check with your own insurance company to determine whether you have medical payment coverage. If you do, you can make a claim with them to reimburse you for your co-payments and they are obliged to pay them up to the amount of your med pay coverage.
