Legal Question in Personal Injury in California

Rear Ending help!

So I decided to stop at a green light because after a couple other cars had cut in front of me I would have been stuck blocking the intersection. I was in the left lane (out of 2 lanes) and another driver hit me from behind on the left side of my rear bumper. We pulled over, exchanged name/phone numbers but he said he didn't have his insurance card on him. I called the police but they said they wouldn't make a report unless there was an injury. I got an estimate, called the guy and told him, and he said he didn't care what I did, it wasn't his fault, he'd make it my fault whatever I said. There was a bunch of people who saw, but of course no one actually stopped! I don't know what I should do now!! Thank you!!!

Have you seen a doctor? Have you suffered any injuries?

Assuming no injury to you from the post, I would file and submit my SR-1 form, as required by the DMV if over $500 in property damage.

Shortly after, I would fill out and submit (and pay appropriate fee) an SR-19 DMV form to obtain information as to whether this guy was insured.

If so, you get that info, and you can forward a demand to his insurance co.
