Legal Question in Personal Injury in California

who is responsible for damage to truck

Truck parked at worksite was damaged by superintendent of company and his son(who was an employee of co.) when they got into a fistfight. Superintendent admits he got into fight but is not sure he caused damage even though he admits he saw my truck at begining of work undamaged. No eyewitnesses. Superintendent, foreman, and person in charge of finances for that jobsite say that company will pay for damages. I have witnesses to them stating company will pay. After waiting for 1 1/2 months they tell me their insurance will not pay for it and I need to go after the superintendent to pay for it. Superintendent does not work for company any more. I am trying to figure out who take to small claims court for damages. Damages total $1250. I feel the company is liable because he was their superintendent and I was told all along company would pay for it. I would appreciate advice on who I should go after for damages. I have witnesses that my car was not damaged in morning when I parked.

Sue everybody (father, son, company) in small claims court. Let the judge sort it out.
