Legal Question in Personal Injury in California

Ripped off

my truck rooled down my driveway and damaged my neighbors wood retaining walls,now they say I owe 3,789 dollars,I don't have ins.on my truck or home,I am a contractor and I know to fix the walls does not cost that much what can I do?

I'd offer to fix the wall. Then I'd take a lot of pictures of the wall before, during the repairs, and after the repairs. Then when they sue you. Bring another contractor to help you offer expert opinions. You'll probably be sued in Small Claims Court. So watch a few of the programs on TV to get the idea of how the court is conducted. Remember the real Small Claims Court is not as interesting.

(1) Ask for a copy of the repair estimate . . .

(2) Make an offer for what you think it would cost . . .

(3) If you both agree on an amount to settle their claims, get a release from them saying that they release you from any and all claims . . . you should have counsel give you a release form to protect yourself from future claims . . .

Offer to fix it. If they would not agree, take pictures, write an estimate of the damage, bring another contractor to write another estimate. In other words, gather evidence to show that you are being ripped off.
