Legal Question in Personal Injury in California

slip and fall major store

My sister fell at a major retail(T) store in California.Someone had spilled dish soap on the floor. She was flat on her back they did not even try to make her comfortable or anything untill the squad came.In the result of the fall she hurt her back and had therapy and will probably hurt for the rest of her life. She did get a lawyer and they first offered her $5000.00 she told the lawyer no because after he takes his part and after Dr. bills it certainly don't leave much for her pain and suffering. Then a couple weeks later they called her with a $7000.00 offer and does not have to pay attorney fees nor medical bills. She did not work before nor after the slip and fall. She ia stay home grandma. She is 49 years old if that matters. My question is does this sound right? Should she settle or say no?

Something is wrong here. Tell your sister to get her file to another lawyer for a second opinion.

To answer this question I would really need to speak to your sister. A major concern is the date that the accident occurred. In other words, are we approaching the two-year Statute of Limitations? If there's still at least nine months to go, then there's still time for a second opinion.

It worries me that the lawyer is offering to waive his fees. That might mean the case is in bad trouble. Call me right away at 877-LION-FOR-LAW for a free consultation
