Legal Question in Personal Injury in California

My son ( a minor) was involved in an accident over 8 months ago, he was not issued a ticket. Now we were summoned to court on misdemenor charges for reckless driving. They said if he pleads guilty they were offering him probation, community service and he would loose his license for a year. He is being punished for something he did not do. It was just an accident. Should we get an attorney or use the public defender? Should he plead guitly or should we go to trial since he was not driving reckless?

Public defender = pleading guilty in my opinion. Get an attorney and fight.

Just take a public defender to learn how strong the evidence is against you. then you may need to hire a more powerful fighter for an atorney.

You can fight the charges. When arrested or charged with any crime, the proper questions are, can any evidence obtained in a test, search or confession be used against you, and can you be convicted, and what can you do? Raise all possible defenses with whatever admissible and credible witnesses, evidence, facts and sympathies are available for legal arguments, for evidence suppression or other motions, or at trial. If you don't know how to do these things effectively against an experienced prosecutor intending to convict, then hire an attorney that does, who will try to get a dismissal, diversion, reduction or other decent outcome through plea bargain, or take it to trial if appropriate. If you can afford private counsel, you won't qualify for the Public Defender anyway. They are only appointed for those who qualify.

Get a criminal attorney. You don't want your boy to lose his license and have a conviction on his record. If you can afford a private attorney, get one.
